SIC directs BDO Marwah to provide info

Jammu, Feb 18: The State Information Commission (SIC) has directed the Block Development Officer (BDO) Marwah to provide details under RTI Act to an information seeker which had allegedly been denied earlier. Information seeker had sought details about works executed in village Youdoo Pathgam from 2012 to 2017 under NREGA, BRGF, CDF, MP LAD etc.
Details available with Early Times reveal that one Akhter Hussian R/O Paloura Jammu filed an RTI application with the Public Information Officer (PIO) Assistant Commissioner Development, Kishtwar on 03-04- 2017 seeking following information:
1. Xerox copy of approved annual works plan of Panchayat Yourdoo and Panchayat Pathgam Block Marwah for the period 2012-13, 2013-14, 2014-15, 2015-16.
2. Full detail of works executed under all heads including MGNREGA, BRGF, CDF, MPLAD etc. in Panchayat Yourdoo and Panchayat Pathgam Block Marwah for the period 2012-13, 2013-14, 2014-15, 2015-16.
3. Full detail of Jab Card holders of Panchayat Yourdoo and Panchayat Pethgam Block Marwah, alongwith the work on which they worked for the period 2012-13, 2013-14, 2014-15, 2015-16 and the payment paid to them year wise, work wise specifically mentioning the account numbers/bank details of each job card holder.
4. Detail of beneficiaries in whose favour the sanitation units (HHL) has been sanctioned alongwith detail of payments made to them and mode of payment in Panchayat Yourdoo and Panchayat Pathgam Marwah.
5. Year wise detail of funds received by BDO office and year wise detail of expenditure made for the period 2012-13, 2013-14, 2014-15, 2015-16.
The information was denied by BDO and after filing appeal before ACD Kishtwar the appellant was not satisfied. Finally the appellant filed 2nd appeal before State Information Commission (SIC).
The appeal was adjourned BY sic twice for non appearance of respondents and appellant on 16-11-2017 and 15-12-2017 respectively. The final hearing of the appeal came up before the SIC on 02-02-2018. The hearing was attended by BDO/PIO Marwah and the appellant. During the hearing the PIO assured the Information Commissioner Mohammad Ashraf Mir that he will provide the requisite information to the appellant within one week.
" The appeal is disposed of with the directions to the PIO/BDO Marwah to provide the information to the appellant within one week time from today. In case the PIO fails to provide the information to the appellant within the aforesaid period, the appellant shall be at liberty to file a complaint before the SIC in terms of section 15 of the RTI Act, 2009" reads SIC order of 2.2.2018
