Transfer, relieving orders issued in violation of previous DULBK circular
GPF cases still pending, recent appointees transferred, relived by EOs

srinagar, Apr 25: The former director of Urban Local Bodies Kashmir (ULBK), Tufial Ahmad Matoo held a series of meetings with Executive officers of Municipal Councils/Committees of Kashmir Divisions where he reviewed the functioning/progress on various fronts of these institutions.
According to a circular vide no: DULB/A/1900/2284-2328 Dated 21-05-2013, the circular said that the EOs of some Municipal institutions have relieved officials of their institutions to other MCs/Committees without having jurisdiction/competence to do so, which amounts to grave negligence and sheer violation of Law/Rules of part of the concerned EOs and.
It is enjoined upon all the EOs of MCs to cancel all such orders immediately, if issued. The EOs are further directed not to draw the salaries of the employees, who have been relieved at the committee level, without having any formal order of transfer from the competent authority, said circular.
The circular further said that any deviation or non-compliance of the aforementioned instructions on part of any EOs shall be viewed seriously and the case shall be referred to the government for stern administrative action against the defaulting officer.
Meanwhile the Administrator MC Leh of Ladakh division relieved its employee on 06-02-2018 vide no: MCL/P/2018/2328-31 Dated 05-02-2018.
The order said that, "as per the telephonic conversation held with Director, ULBK Srinagar, Smt Jamila Bano Safaiwala of this officer is hereby relieved today on 06-02-208 FN".
The order said that she is directed to report the office of the Executive Officer MC Pulwama for further duties, adding the service book and LPC of the official are enclosed for further information and necessary action.
Another type of transfer/relieving order was issued by the EO, MC Pahalgam vide no: MC/PGM/17/2889-95 Dated 05-02-2018.
The order said that, in pursuance of directions of worthy director ULBK on the basis of health grounds, Smt Farooqa Parveen Junior Assistant is hereby relieved today on 05-02-2018 and is directed to report MC Awantipora for further duties, adding the LPC and service book will be followed separately.
Meanwhile reliable sources in the ULBK told early times that, according to previous circulars issued by the then director of ULBK, Tufial Ahmad Matoo who had categorically mentioned that no EO of any MCs are authorized to issue transfer or relieving order, as such things could be only done by the competent authority that is the Director ULBK.
"General Provident Fund (GPF) cases of 1996, 98, 99 and so on of the employees are not sanctioned by the directorate office nor does their time bound cases are solved as the authorities believe that appointment is 'illegal', said sources.
They said that, a high level enquiry committee was formed by the government to examine the cases of 1996-98, and at the same time one fails to understand that how some employees who were appointed in 2014 or 2008 are enjoying their services including transfer of their choicest placing.
It is unfortunate that from other hand, the EOs have once again started the practice of relieving the illegal appointees by issuing fraudulent/ motivated relieving orders which does not hold any merit, sources added.
