Prosecution failure leads to acquittal in double murder case

Jammu, June 18: Principal Sessions Judge Udhampur KS Parihar acquitted Jagpaul alias Jagga, Om Parkash alias Omi, Hari Dass alias Hriya, Balbir alias Bali and Tara chand alias Kahu in double murder case as prosecution failed to prove its case.
According to the police case, during the intervening night of February 1, 2011 two persons Moti Ram and Bodh Raj working as Electricians in Main power house GE (utilities) were murdered by some unknown persons. During the investigation police found that before the occurrence on 26-1-2015 during an alleged quarrel and a fight that took place between accused Jagpaul and deceased persons one of the deceased namely Moti Ram had slapped the accused Jagpaul and in order to avenge this humiliation he conceived a plan to murder the deceased persons as and when he got an opportune time and that on 30.1.2011, accused Jagpaul along with four co- accused persons in the residential quarter of his father situated at MES Chopra shop, bearing quarter no. 20/8, at around 8 PM finalized the plan and conspiracy to murder the deceased persons which was finally executed on 1st of Feb. 2011 when all of them at around 9.30 PM gathered near petrol pump situated at Chopra shop towards the side of a nallah where they were seen by the people and prosecuting witness Pritam chand.
Principal Sessions Judge Udhampur KS Parihar after hearing Adv Anmol Sharma and Adv Shebba Sethi observed that the prosecution miserably failed to prove the circumstance relied upon by it to prove the guilt of the accused as per the requirement of law and the accused were acquitted.
