Contractor's appeal against ACD, BDO rejected
SIC terms it misuse of RTI Act

Jammu, Aug 27: In a significant order State Information Commission (SIC) has rejected an appeal filed by a Contactor from Mahore Reasi who is chronic RTI user. The SIC termed the appeal as motivated and exploitative as the contractor has been misusing RTI for his personal gains.
Details available with Early Times reveal that one Mohammad Ayoub Ayan R/O Mahore District Reasi filed an appeal before State Information Commission (SIC) against Assistant Commissioner Development (ACD) Reasi & Block Development Officer (BDO) Mahore.
Information seeker alleged that he was being denied information by the officers.
State Information Commissioner M A Mir while issuing the order said that appellant is a contractor by profession and is in a habit of filing multiple RTI applications to harass Govt officers.
The Commissioner rejected his appeal on the plea that he was only interested in seeing officers getting penalized rather than getting the information.
CIC in his order ruled, "It is also found that the appellant namely Mohammad Ayub Ayan has filed scores of applications before the numerous public authorities and has received information against almost all the applications. The information taken from the government records runs in hundreds and thousands of pages.
He has been particularly concentrating for this purpose in his native districts of Ramban and Reasi and has also filed number of applications with Revenue, Estates, Education and other departments in other districts also. He has also approached the Commission in number of appeals and complaints which have been disposed of by the Commission by ordering for the disclosure of the information.
Therefore, the Commission would once again require the appellant to give the details of various kinds of information received by him from various government and semi government departments, agencies and institutions and also to report whether he\ has made any reference to State Accountability Commission, State Vigilance Commission and State Vigilance Organization or any other competent authority.
