New Delhi, Dec 10: The Supreme Court on Monday dismissed a petition filed by former BJP MLA Gagan Bhagat concerning to the dissolution of the Jammu and Kashmir Legislative assembly.
Rejecting the petition Chief Justice of India Ranjan Gogoi stating noting no merit in the petition said," We (Supreme Court) are not inclined to interfere" Earlier the PDP, National Conference and the Congress, who have been trying to establish a new government in Jammu and Kashmir, have received a big blow from governor Satyapal Malik. Amidst the ongoing talks of a possible PDP-NC-Congress alliance to form a government, governor Satyapal Malik has dissolved the Assembly.
PDP had written a letter to the governor presenting the claim to form the government. PDP had sent this letter to the governor's office through fax. However, in strange circumstances, the Governor did not receive it. Malik later cited technical issues with the Fax machine as the reason. Former Chief Minister of the state Mehbooba Mufti tweeted and informed that this fax has not been received from the Governor's office nor the governor is answering the phone.
Mufti, while writing a letter to the Governor, had said, "As you know, PDP is the largest party with 29 MLAs in the state assembly. Through media, you may have been informed that Congress and National Conference have agreed to form a government with PDP."
However, Governor Satyapal Malik ordered the dissolution of the assembly under section 53. Along with this, reports of a revolt in PDP started coming out. Some legislators opposed the formation of the coalition government. |
