JKTDC encroaches land of PHE at Harwan carries out illegal construction
Despite repeated requests to stop work no action taken so far

SRINAGAR, Dec 10: The state government has been asking the people to remove encroachments but one of its own departments is encroaching the land of some other government department.
Assistant Executive Engineer, City Water Works Sub Division Srinagar of Public Health Engineering (PHE) department wrote a letter to Lakes & Waterways Development Authority (LAWDA) asking them to take action against the Jammu & Kashmir Tourism Development Corporation (JKTDC) since the corporation has carried out illegal construction on the land belonging to PHE department.
"Kindly refer your Letter NO: LDA/EO/22/38-39 dated 17-04-2018 regarding subject captioned above. In this connection it is to inform you that instead of your strict instructions, the authority of JK Tourism Development Corporation Srinagar has restarted the illegal construction on the land belonging to PHE department during night hours," reads the correspondence shot by Assistant Executive Engineer, City Water Works Sub Division Srinagar.
The correspondence reads, "The said contractor concerned in whose favour the JKTDC has issued allotment for said illegal construction has also been authorized to cut down green willow trees vide letter No. JKTDC/AEE/M&W/01-Camp dated 24-11-2018 without proper permission from prescribed authority."
In the correspondence it has been written that JKTDC has violated the Water Regulation Act, 2010 Clause 83 and the same is punishable offence. It says that action under rules should be taken against the JKTDC so that the general public health and natural environment are not affected.
The correspondence has been shot under correspondence number CSD/1509-1517 dated 1-12-2018. The subject mentioned in the correspondence is construction of a hut at Green Park Harwan, Srinagar and cutting down of green willow trees. It has been issued with reference to office letter No. CSD/1440-43 dated 04-04-2018 and reminder letter No. CSD/1500-08dated 12-11-2018.
The contract to construct the restaurant cum cafeteria at Harwan has been allotted to M/S Guroo Constructions, Dalgate Srinagar. Assistant Executive Engineer, JKTDC has asked the contractor to cut down the two willow trees lying adjacent to roof line may be cut down since the same are hindering the construction work. The contractor has been asked to chop off the trees to the required size and stack them properly.
On 12-11-2018 Assistant Executive Engineer, City Water Works Sub Division Srinagar shot off a letter to Enforcement Officer, LAWDA Srinagar asking the officer to take action against the authority of JKTDC since it has started the illegal construction without proper permission. The letter has been shot under correspondence number CSD/1500-08.
Before this correspondence a letter was shot by Assistant Executive Engineer, City Water Works Sub Division Srinagar on the same topic to the Enforcement Officer, LAWDA Srinagar on 04-04-2018 under correspondence number CSD/1440-43.
In response to this correspondence the Enforcement Officer, LAWDA Srinagar wrote that the department of Tourism has started to dismantle the old existing shed on wooden logs inside the Green Park, Harwan adding that no new/recent construction has been done on spot. This letter was shot under correspondence number LDA/EO/38-39 dated 17-04-2018.
Despite the denial of JKTDC the construction of illegal building is going on with the labourers busy at the site of work even today.
