Court acquits accused in hyped murder,drugs case

Jammu, Jan 30: 2nd Addl. Sessions Judge Jammu V S Bahu today announced the judgment in the much publicized Divya Manhas Murder by Drugs overdose case and acquitted three accused namely Yashjeet, Robail Sharma and Vikram from the offences of murder and NDPS.
Sessions Judge V S Bahu in an elaborate judgment discussed all the witnesses and their testimonies and the investigation and finally found that the case could not be proved by the investigation of the Crime Branch and therefore acquitted all the accused, in a judgment announced in the open Court.
The case was transferred to Crime Branch Jammu and S.I.T. was constituted and the Crime Branch arrested three accused namely Vikram Singh, Rubail Sharma S/o Mansa Ram and Yashjeet alias Kalia alia Chacha S/o Chaman Lal. R/o Vill. Serat P/o Damtal, Tehsil Indora Distt. Kangra of Himachal Pradesh.
A K Sawhney Advocate who represented the main accused in the case submitted before the court that entire case is based on circumstantial evidence. The chain of evidence does not match and incriminate in any manner. So much so four independent witnesses were declared hostile and dented the Prosecution story. Nothing could be recovered from Yashjeet or any other accused. No drugs whatsoever were recovered from the accused Yashjeet who was styled as the drug peddler. The investigation is faulty, defective and thus on the basis of suspicion howsoever strong it may be, one cannot be convicted.
2nd Addl. Sessions Judge V S Bahu, evaluated the Prosecution evidence on the touchstone and guidelines held by apex court and thus found the case is not proved beyond any shadow of doubt and the witnesses statements are contradictory and thus acquitted all three accused.
It may be mentioned that this case was much hyped as it exposed that the youth of Jammu were badly into drugs and many such drug addict children were falling prey to the drugs.
The fate of the much hyped case was that the State failed to properly investigate the case and merely created a hype in the matter and finally the said case failed the test of judicial scrutiny and the Court acquitted all the accused today.
