Govt orders prosecution of 2 persons for instigating people after Burhan Wani's killing

SRINAGAR, Jan 30: The state government has ordered prosecution of two persons including Jammu and Kashmir Liberation Front activist Noor Mohammad Kalwal for "instigating" people by praising Burhan Wani, Hizb-ul-Mujahideen commander who was killed in an encounter with security forces at Kokernag on July 8, 2016.
The Home Department has issued SRO to accord sanction to prosecute Noor Mohammad Kalwal of Nowhatta and the other person, Abid Ahmad Beigh of Chinkral Mohalla, a "hardcore stone pelter".
"Police Station M R Gunj received information on 13 July 2016 that at Chinkral Mohalla Habba Kadal (in downtown Srinagar) two persons (Noor Mohammad Kalwal and Abid Ahmad Beigh) have assembled and are praising the killed militant Burhan Wani thereby disturbing the peace and tranquility of the area, by raising pro-freedom and anti-national slogans," reads the notification issued by the Principal Secretary Home Department.
Police filed a case FIR (No. 60/2016) U/S 13 ULA (P) Act in Police Station M.R Gunj and, according to the notification, initiated the investigation. "The investigation conducted has prima facie revealed involvement of the accused persons for the commission of offence punishable u/s 13 ULAP Act and accordingly the case has been concluded as proved against them."
After perusing the material, the home department said it was convinced that there was enough material available to prosecute the accused duo. "In exercise of the power conferred by sub-section (2) of section 45 of the Unlawful Activities (Prevention) Act , 1967, the state government hereby accord sanction for launching prosecution of (Noor Mohammad Kalwal and Abid Ahmad Beigh) for offences punishable under section 13 Unlawful Activities (Prevention) Act, 1967, arising out of the FIR no. 60/2016 of police station M R Gunj Srinagar," it adds.
