SIC directs BDO Jakyas to file compliance report

Doda, Feb 27: The State Information Commission (SIC) has directed Block Development Officer (BDO) Jakyas block in Doda who is also the designated Public Information Officer (PIO) under State RTI Act to file compliance report vis a vis SIC's order. The SIC had earlier directed the BDO to provide information under RTI Act to two information seeks who were denied information about works executed under MGNREGA , CDF and IAY etc in Chinyas Panchayat of the block.
Details available with Early Times reveal that two applicants, Touseef Iqbal and Farooq Ahmad both residents of Village Chinyas Block Jakyas District Doda on 01-06-2018 filed an application under RTI Act before the concerned BDO / PIO seeking information regarding works executed under MGNREGA in all wards of Panchayat Chainyas from 2012 to 2018 . In addition to it details of CDF MP-Lad , PMAY, works was also sought.
With no response from the BDOs office the applicants filed first appeal before the First Appellant Authority (FAA) ie ACD Doda on 04-08-2018. Aggrieved with the response from ACD Doda , the applicants filed 2nd appeal before the State Information Commission (SIC) Jammu on 01-10-2018.
The appeal came up for hearing before the State Information Commission (SIC) on 27-12-2018. One of the appellant was present. One Mr Basharat, Gram Rozgar Sevak (GRS) represented the PIO/BDO Jakyas. He submitted before SIC that the information sought by the appellants was collected and sent to the home address on two occasions, but the home of the appellant was found locked on both occasions. According to GRSs statement before SIC, the appellant never contacted the office of the PIO/BDO Jakyas for collecting the information.
The hearing was accordingly adjudicated by SIC with a direction to the PIO / BDO Jakyas to send the requisite information to the appellants by registered post within a period of one week
The appeal again came up for hearing before State Information Commission (SIC) Jammu on 01-02-2019. The PIO failed to inform the Commission whether the requisite information has been furnished to the appellant. This was viewed seriously by SIC .
"Since the maximum period for deciding the appeal by the Commission is expiring, no further adjournment can be given in the appeal. The appeal is accordingly disposed of with a direction to the PIO to file compliance report before the State Information Commission within a period of two weeks from the date of receipt of this order with regard to implementation of the directions given by the Commission vide its Interim order dated 27-12-2018. In case the appellant has not received the requisite information from the PIO, he is given liberty to file a complaint against the PIO/BDO Jakyas before the Commission under section 15 of the J&K RTI Act, 2009.
