Jammu, Mar 2: The High Court of Jammu has directed to withheld the salary of Commissioner Jammu Municipal Corporation and Executive Engineer, Trikuta Division, Municipal Corporation, Jammu till further orders in a contempt petition filed by Mahamaya Engg seeking initiation of contempt proceeding against the alleged contemnor for willfully, knowingly, intentionally, malafidely and deliberately disobeying the order dated 31.12.2018 of this Court passed in OWP No. 2695/2018.
Justice Sanjay Kumar Gupta after hearing Adv Karan Sharma for the applicant observed that despite directions, statement of facts has not been filed by the respondents and directed that the salary of Commissioner Jammu Municipal Corporation and Executive Engineer, Trikuta Division, Municipal Corporation, Jammu be stopped till further orders.
During the course of hearing Adv Karan Sharma submitted that in spite of staying the operation of the allotment order by this Court, the respondents/contemnors has violated the orders passed by this Court by allowing the contractor to whom the contract has been illegally allotted, i.e., respondent no. 3, to carry on the upgradation work on spot and which is still going on. The alleged Contemnors/Respondents herein have failed in its entirety to implement the order dated 31-12-2018 even after having knowledge of the same and the contemnors illegally, malafidely allowed the contractor, i.e., respondent/contemnor no.3 to carry on the work on spot. --(JNF) |
