Dilbag Singh's Land grab case

In September 2012, Jammu based newspaper, Journey Lines, had carried out a detailed story about the involvement of then Inspector General of Police-Jammu range Dilbag Singh, in alleged land grab case.
Justice Virender Singh of Jammu and Kashmir High Court took the cognizance of the news stories carried by Journey Lines newspaper and Justice Singh while dictating the order in the open court observed that the instant miscellaneous application needs to be listed in the supplementary list and taken up with the main petition. "Through the instant application the petitioner seeks permission to place on record two paper clippings annexed as Annexures A and B" the Court had observed while dictating the order.
Petitioner Madan Aggarwal had stated :"That the afore- titled petition u/s 561-A Cr. P.C. is pending disposal before this Hon'ble Court in which the petitioner has sought quashment of FIR No. 06/2012 u/s 420 RPC registered with Police station City, Jammu against the petitioner in which two more offences under section 468 and 471 RPC have been subsequently added.
That the petitioner in the afore- titled petition have leveled serious allegations as against the respondent no. 4 (Dilbag Singh) and based his pleading on the ground that the impugned FIR has been registered against him on the asking and influence of respondent no. 4, who has entertained hostility and grudge against the petitioner as the petitioner has exposed his nefarious designs of encroaching upon the land belonging to the wife and sister- in- law of the petitioner.
The petitioner Madan Lal Aggarwal son of Lt Krishan Lal Aggarwal R/o H no. 98- A/D Gandhi Nagar Jammu had filed a quashing petition under section 561 A CrPC against the State of J&K through Pr Secretary Home Department, SSP Jammu, SHO Police Station City Jammu and Dilbag Singh, IPS - then Inspector General of Police Jammu Zone.
In the petition the High Court vide the earlier orders had stayed the investigations in the FIR no. 6/2012 u/s 420/ 468/471 RPC etc registered at Police Station City Jammu.
In the said petition filed by Veenu Gupta and Sumit Singh Advocates and settled by Sunil Sethi Sr Advocate, serious allegations against the Dilbag Singh- had been leveled.
In the objections the State and the respondent had denied the same and leveled allegations against the petitioner of being a fraud and also that earlier FIRs stand registered against him and his family.
The relevant excerpts of the petition leveling allegations against Dilbag Singh were as follows:
Singh has an eye over the land measuring 25 kanals falling in Khasra No. 658 min. khewat No. 26 and khata No. 428 situated at Chowadhi, Tehsil & District Jammu belonging to the wife and sister -in- law of the petitioner. Singh has tried to encroach the said land on couple of occasions through his stooges, but the said illegal attempts and efforts on the part of Singh were thwarted by the petitioner by taking resources to the provisions of law including by filing civil suit and contempt petitions. In the contempt petition so filed, specific allegations were leveled against Dilbag Singh . A copy of the order dated 28.02.2011 passed by Court of Learned 1st Civil Subordinate Judge, (Municipal Magistrate), Jammu in contempt petition titled Veena Aggarwal & another vs. Prabha Gupta contempt petition is enclosed herewith as Annexure- B.
That it is pertinent to mention that since his posting as Inspector General of Police, Jammu, Dilbag Singh has let loose the rein of terror and is falsely implicating the petitioner in number of cases one after the other without any allegations and even detained the petitioner in custody in reference to non- existing cases.
That all the efforts are being made by Singh to pressurize the petitioner to surrender his land to him and to succumb to the pressure tactics.
Singh is abusing his official position and is misusing the police machinery against the petitioner for ulterior motives which is highly deplorable.
That a mere reference to the FIR impugned clearly shows that neither section 420 of Ranbir Penal Code is made out as there is no cheating or inducement of property nor is there a case of forgery as punishable under section 468 or 471 of the Ranbir Penal Code. However, the FIR has been falsely lodged against the petitioner just to victimize him for ulterior consideration and motives.
That the behaviour and conduct of Singh is unbecoming on the part of a senior police officer who is taking the law in his own hands for the purposes other than legal and by forcing the peace loving citizens to surrender their immovable properties in his favour. ..."
