| Court rejects bail of alleged charas smuggler | | | Early Times Report
JAMMU, July 11: 4th Additional Sessions Judge Srinagar Haq Nawaz Zargar rejected the bail application of one Khursheed Ahmad Dar, son of Ghulam Nabi Dar of Tulkhana Bijbehara, District Anantnag from whose possession 920 grams of Charas was recovered.
4th Additional Sessions Judge Srinagar Haq Nawaz Zargar after hearing both the sides observed that it had been seen that a new modus operandi had been adopted by the criminals that they resort to smuggle contrabands in small quantity or for that matter any quantity lesser than the commercial for getting benefit and taking advantage of some provisions of law. The court has not only to go by the provisions advantageous to the accused but at the same time has to see the stage of investigation, the type of evidence, the material recovered and seized and lastly the impact of commission of crime on society which has already been discussed in para supra . In the instant case keeping in view the gravity of the offence and its impact on the society coupled with the stage of investigation, this court feels that the bail application of the accused/applicant be rejected. Accordingly, this bail application is rejected.
