Jammu, Aug 9: The TADA Court Jammu on Friday has issued general arrest warrants against JKLF Chief Amanullah Khan and others in two cases regarding killing of five Airforce personals at Batmaloo in 1990 and in kidnapping of Rubiya Syed -daughter of former Chief Minister Mufti Mohammad Sayeed. Presiding Officer TADA Court Jammu Subash Gupta issued general arrest warrants against JKLF Chief Amanullah Khan, Javed Mir, Dr Ghulam Qadir and Abdul Rehman Dar. The court also issued General Arrest Warrants against Riyaz Bhat, Kuhursheed Ahmed Dar, Basharat @ Bitta Karate, Tareeq Ashraf, Shafat Ahmad, Manzoor Ahmed @ Nan, Abdul Majid Bhat, Nissar Ahmed Mohd Yaqoob, MS Halima, Javed Iqbal Mir, Mohd Yaqoob Pandit and Gh. Mohd Taploo in kidnapping of Rubiya Syed case. Today when the matter was taken-up, Presiding Officer TADA Court Subash Gupta after hearing Spl PP- S K Bhat, ALA/CBI/HQ, New Delhi alongwith PP-CBI- Vijay Kumar Dogra are present for the state.
Court further observed that accused-Shoukat Bakshi, Mohd Rafiq, Javed Ahmed Mir, Manzoor Ahmed Sofi, Javed Ahmed Zarger and Ali Mohd Mir are not present. They are exempted for today's date of hearing as an application, in this regard is filed by their counsel. At this stage, an application is filed by the CBI seeking issuance of warrants for the arrest of the accused against whom proceedings in terms of Provision of Section 512 of Code of Criminal Procedure, have been initiated vide interim order dated 17.9.1991. The court after hearing both the sides and perusal of the application filed by CBI observed that It is reported by the office that despite order dated 17.9.1991, due to oversight, warrants have not been issued for the arrest of the accused against whom proceedings in terms of Provisions of Section 512 of Code of Criminal Procedure have been initiated vide afore referred interim order. Prayer of the CBI is accepted. Accordingly, it is ordered that the warrants for the arrest of the accused against whom proceedings in terms of Provision of Section 512 of Code of Criminal Procedure have been initiated vide interim order dated 17.9.1991, be issued. Those be handed over to the Public Prosecutors present for the CBI for execution.
