HC directs SDM Jammu North to take action against encroachment of State land

Jammu, Jan 5: Taking a serious note on the nonchalant attitude of Jammu Administration for not taking action against the encroachers of State land at Barnai are of Jammu, the High Court of J&K directed the Sub Divisional Magistrate (SDM) North Jammu to take action against the encroachers to retrieve State land. As per High Court order, the directions were issued to Sub Divisional Magistrate (SDM) Jammu North to take appropriate action in the matter to find out as to whether any encroachment has already been done or the State land is sought to be encroached upon any one. The villagers of Lower Barnai had filed the petition in the High Court regarding encroachment of Gair Mumkin Choi/ Nallah (Water Bodies) falling under Khasra No. 99 measuring land 17 kanals 14 marlas situated at village Lower Barnai of Tehsil Jammu (North) and subsequent illegal construction on it by encroachers, which was used for free flow of seasonal rainy water.
Taking their petition into consideration, the High Court on 03-01-2020 issued an order directing SDM Jammu North to restore the position as it exists prior to encroachment of Choi/ Nallah for natural flow of water, which has its origin since land and having natural flow of water. The villagers of Lower Barnai, told Early Times that the concerned administration showed laxity on this serious issue for not taking action, which helped the encroachers to grab State land. They said that they had filed a complaint with the Deputy Commissioner Jammu in 2016, who forwarded the complaint to concerned SDM Jammu North directing to take appropriate action but the nothing was done. Later a delegation of villagers called on Advisor to Governor in this connection on 3-10-2018, who forwarded the matter to DC Jammu, and then it was sent to SDM Jammu North for necessary action and asked to submit report within action but the directions of senior officials were not complied with. After total failure of SDM Jammu North to take action against encroachers, the locals again met with Advisor to Governor on 7-12-2018, who sent reminder to DC Jammu on 3-1-2019, moreover a complaint (ID NO. 999001035813) was also lodged in Governor Grievance Cell on 12-3-2019 but when villagers didn't find any relief from administration, they approached High Court, who took serious note and ordered to SDM Jammu North to take action.
