JAMMU, Jan 11: 3rd Additional Sessions Judge Jammu Subash Gupta awarded four years imprisonment and a fine of Rs 10,000 to Girdhari Lal son of Punnu Ram of Rajiv Nagar, Narwal Bala, Jammu in 354 RPC.
While awarding sentence, 3rd Additional Sessions Judge Jammu Subash Gupta observed that accused is convicted for an offence relating to criminal use of force which led to outraging of modesty of the prosecutrix, a teenage girl having an age of 13/14 years as assessed by the Radiologist. Court further observed that taking into consideration the mitigation and aggravated circumstances as involved in the present matter, age of the accused, his past antecedent, first offender, gravity, heinousness and punishment provided for the commission of the offence under Section 354 of Ranbir Penal Code and other relevant factors, I am of the considered opinion that the mitigating circumstances have over weighed the aggravating factors for not sentencing the accused to the maximum punishment as provided for the commission of offence under section 354 of RPC. Accordingly, he is being sentenced to imprisonment for a period of four years and a fine of Rs 10,000. -JNF
