Five awarded life-imprisonment in double murder case

Udhampur, Feb 3: Additional Principal Sessions Judge Udhampur S R Gandhi today awarded life-imprisonment to five accused who were facing trial in a double murder case.
After hearing Additional Public Prosecutor Anil Magotra and defence counsel, Additional Principal Sessions Judge observed, that court has come to conclusion that prosecution has proved the case against the all the accused Prem Nath, Sita Ram, Krishan Chand sons of Massu, Babu Ram son of Sita Ram and Guddi son of Massu all residents of Sadhota Mohra Sanal in Udhampur as they have committed the murder in a broad day light in presence of some witnesses.
Accordingly all the accused persons are convicted for the commission of offences under sections 302/ 449/147/ 148/ 149/120-B RPC & 4/25 Arms act. The facts of the prosecution case in brief are that deceased Krishni was a window and her only daughter had also died. Accused Prem Ntah had eyes over her property and intended to grab it in the meantime Krishni brought her maternal grandson deceased Parkash Singh in her house and started his up brining.
Accused apprehended that lest she may give her entire land to deceased Parkash Singh hatched a criminal conspiracy and in furtherance of the common object in the intervening night of 6th and 7th of September 2011 brought both the deceased from the house and committed their brutal murders by sharp edges weapon. In support of the case prosecution has examined 22 witnesses and in defence two witnesses have been examined. After hearing both the sides in length, additional Principal Sessions Judge awarding sentence said that Earth provides enough to satisfy every mans needs, but not every mans greed Mahatma Gandhi. The case at the hands reveals as to how a man for greed can go to such an extent.
The deceased Krishni Devi was a widow whereas deceased Parkash Singh was an innocent child aged about 10 years. She had no issue to look after her. She would have expected much from the innocent grandson which was a ray of hope for her rest of the life and crutches for her time to come. She would not have expected that a little benevolence of accused in performing the obsequies of her deceased husband would cost not only her property but the life as well.
Awarding sentence judge ordered that for the commission of offence under Section 302 of the RPC all the convicts namely Prem Nath, Sita Ram , Krishan Chand, Babu Ram and Guddi shall suffer imprisonment for life and a fine of Rs.10,000/- each. For the commission of offence under Section 449 RPC each of the convicts shall undergo rigorous imprisonment for 10 years and a fine of Rs. 5,000/- For the commission of offence under Section 147 RPC each of the convicts shall undergo rigorous imprisonment for three years (three years).
