NIA arrests one more in suspended DySP case
Court grants seven days police custody

JAMMU, Feb 12: In a much publicized case of suspended Dy SP Devinder Singh, NIA arrested one more person identified as Tanveer Ahmed Wani alias Tanveer Bardaa. NIA produced Tanveer Ahmed Wani alias Tanveer Bardaa before Special Court. Special Judge NIA Subash C Gupta granted seven days police remand.
In application has been filed by CIO -A.D. Negi, Superintendent of Police, NIA seeking police custody of above named accused for 15 days, on the grounds mentioned,therein. It is further in the application that on 10.02.2020, accused was arrested at Delhi. Immediately thereafter, he was examined from Ram Manohar Lohia Hospital New Delhi. According to further contents of the present application, his custodial interrogation is needed for unearthing the conspiracy as involved , in the matter regarding receipt of Funds for carrying out the activities of the banned Terrorists Organization -HM, in Kashmir valley.
Special Judge NIA Subash C Gupta on perusal of the relevant entries of the CD file, it reveals that the case relates to ferrying of two HM terrorists (accused) namely – Syed Naveed Mushtaq Shah and Rafi Ahmed Rather under the earlier hatched criminal conspiracy with their associates, co-accused namely DySP -Devinder Singh & Irfan Shafi Mir towards Jammu ,on 11.01.2020,in a Hyundai I-20 car bearing Registration No. JK-03H-1738. And on getting specific information,they were apprehended at Mir Bazar, Qazigund by the J&K Police.
During search of the afore referred car, one AK-47, 03 pistols, 05 hand grenades, 174 live rounds of AK-47 & 36 live rounds of pistol and other incriminating material were recovered from the same. On this basis , a case FIR No. 05/2020 u/s 18, 19,20,38&39 of UA(P) Act, section 7/25 of Arms Act and section 3/4 of Explosive Substances Act was registered with the Police Station Qazigund. Subsequently, in compliance to the order No. 11011/10/2020/NIA dated 17.01.2020, issued by the Ministry of Home Affairs, Government of India, New Delhi, NIA Branch office Jammu has re-registered a case No. RC-01/2020/NIA/JMU dated 17.01.2020 and thereafter, immediately, set the investigation into motion. On 23.1.2020, in the currency of the investigation, Syed Irfan Ahmad @ Irfan, named herein above was arrested for his role in the larger conspiracy and being a harbourer of the terrorists. It is further surfaced in the investigation that afore named Syed Irfan Ahmed is younger brother of accused- Syed Naveed Mustaq Shah and is instrumental in acting as a go- between him and Dy.S.P Devinder Singh for facilitating their travel for specific mission, in pursuance of their earlier hatched criminal conspiracy, in the matter.
Court observed that keeping in view the facts and the circumstances of the case, gravity and heinousness of the crime as involved in the present matter, submissions made by the CIO and the stage of the investigation of the case, the court is of the considered view that the custodial interrogation of the accused is imperative to facilitate the ongoing investigation.
Accordingly, the court is satisfied that the prayer made by the NIA seems genuine and justified. Hence, the application made by CIO, NIA, in the matter for remand is hereby allowed. The accused is remanded to police custody for 15 (fifteen) days. The CIO is directed to arrange the medical examination of the accused, after every 48 hours during the remand period.
The accused, who is remanded is apprised of his rights to engage legal counsel and to have advice from him, in the matter. JNF
