CAT directs DHK to give NOC to applicant to join as Registrar

JAMMU, June 20: In an application filed by Dr Jan Sarfaraz Nawaz, is that he was appointed as Medical Officer in the respondent department on 29.05.2018. In terms of the interview notification dated 14.05.2020 issued by the respondent No.3 for the tenure posts of Senior Residents / Registrars in Medical College, Anantnag, the applicant appeared and has been selected as Registrar in the said Medical College, Anantnag. It is the further case of the applicant that, as per, condition of order issued by respondent No.3, he is to join the said post within seven days, but that the respondent No.2 has not, till date, relieved the applicant, so as to enable him to join his posting in Medical College, Anantnag. Even the representation filed by the applicant seeking his relieving order has not been disposed of by the respondents.
Central Administrative Tribunal comprising Administrative Member Dr Bhagwan Sahai, Member (HOD) and Judicial Member Rakesh Sagar Jain directed Director Health Services Kashmir to consider and dispose of the representation dated 08.06.2020 (Annexure A-2) filed by the applicant within seven days from today, i.e., 15.06.2020 by way of reasoned and speaking order, with intimation to the applicant by way of email or any other digital / electronic mode on the date of disposal of representation itself. It may be noted that the parties filing the O.A. in the Tribunal have given their electronic/digital address in their pleadings. In any case, the learned AAG for the respondents would inform the concerned respondents about the electronic address of the applicant. In case the representation is accepted by the respondent No.2 and he is given the ‘No Objection Certificate’ to join the post of Registrar in the Medical College, Anantnag, the period of joining shall be deemed to be extended by one week from the date of disposal of the representation, as mentioned above.
