JAMMU, Aug 19 : In a complaint filed by Kamlesh Kumari widow of Lt Harbans Lal whose husband was compelled and forced to commit suicide by the deliberate actions, harassment and abetment by the accused namely Srikant Balashib Suse, SDM Jammu South now posted as Addl. DC Srinagar, Sohan Lal Raina at present posted as Tehsildar Bishnah and Tahir Yousaf at present posted as SHO Police Station Bishnah, Jammu.
Judicial Magistrate Bishnah Ananta Raina after hearing Adv AK Sawhney appearing for the applicant, directed SSP Jammu, to look into the matter and investigate under rules and according to law. Copy of this order be sent to SSP Jammu, for appropriate action and investigation under Section 156 (3) Cr.P.C. In the complaint, it was stated that on 13/07/20 a notice was allegedly issued by accused Srikant Balashib Suse, SDM Jammu South now posted as Addl DC Srinagar and 5 days time was shown as per the notice to be granted to evict the deceased, complainant and their family. The said notice never reached or was served to the complainant or her Late husband or son of the complainant for extraneous reasons and the notice deliberately on extraneous considerations remained with accused Sohan Lal Raina at present posted as Tehsildar Bishnah and on 17/07/2020 accused Sohan Lal Raina Tehsildar Bishnah wrote a note to Office Qunangu. It is prima face admitted by the accused - Tehsildar that said notice was not served upto 17-07-07-2020 upon the complainant and her deceased husband namely Harbans Lal on 18-07-2020. The deceased husband of the complainant came to know about the bad intentions of accused Sohan Lal Raina Tehsildar on 18-7-2020 that he has conspired with accused Tahir Yousaf at present posted as SHO Police Station Bishnah, Jammu and National Highways authorities, private contractor, and have made a plan to forcibly and without adopting the legal recourse of serving the notice upon the complainant or her husband or any member of the family demolished the residential house, protection four wall by using JCB and Police personnel, about 100 persons were brought into two buses including lady police personnel. Whereas on 18/7/2020 itself the deceased husband of complainant approached through written application to accused no. 1 - Srikant Bala Saheb Suse then SDM Jammu South with the complainant and her son namely Sahil.
Srikant Bala Saheb Suse for three hours did not meet the the complainant, her husband and son rather when he met them, he abused the complainant and used filthy language which has tarnished the image of the complainant being woman.
The deceased and complainant were intimidated, harassed and husband of the complaint felt very much bad about such a ferocious and illegal conduct of the accused no. 1 Srikant Balasaheb Suse and even wept before the accused no. 1 - S.D.M Jammu South concerned. That on 18-07-2020 there was weekend lockdown in the evening being Friday on 20-07-2020 and the accused no. 2 Sohan Lal Raina - the Tehsildar Bishnah reached at the residence of the deceased and complainant with force/ personnel and started abusing the complainant and directed the lady constables to catch the complainant from her hair and throw them out of their residential and her deceased husband was mercilessly beaten by the accused no. 3 S.H.O. Bishnah namely Sh.Tahir Yousf. The accused adopted the means and methods which were illegal and criminal and no law permitted such use of illegal and brute force besides abuses and criminal intimidation on the deceased and family of the complainant. That the complainant time and again requested to give some time to make the shifting arrangements since during COVID 19 lockdown they have to make the arrangements for shifting their house and the accused were pressing hard to vacate the house so that they could pave way for the contractor company and the NHAI for making the ring road. That the accused Sohan Lal Raina Tehsildar and accused Tahir Yousaf SHO demolished the protection wall and after mercilessly beating all family members, harassed and humiliated them all using illegal brute force on them. The accused who include Shrikant Bala Saheb Suse, Sohan Lal Raina and Tahir Yousaf by their illegal conduct and illegal actions which are unbecoming of public servants, abetted the deceased to commit suicide who was a peace loving, simple, innocent and common citizen of the country.
