Court rejects bail in minor’s rape, kidnapping case

JAMMU, Oct 15 : Principal Sessions Judge Reasi Kamlesh Pandit rejected the bail application of one Talib Ansari S/O Shamim Ahmed Ansari R/O Nawala Muzzafar Nager (U.P) who was allegedly involved in kidnapping and rape with minor.
FIR No 20 has been lodged by the complainant namely Mst. Suba W/O late Hukam Singh R/O at present Tirantha (Reasi) whereas the other FIR under No.21 has been lodged by Ram Dass S/O Mangal Dass R/O at present W. No.6, Reasi. Both these complainants lodged the missing reports of their minor daughters as their whereabouts were unknown, which missing reports were registered as First information reports for the offence u/s 363 RPC in Police station Reasi.
During investigation the four minor girls, were later on recovered from the custody of the accused/applicant herein at Jammu in which one of the minor daughter of complainant in FIR No.20/2018, alleged rape by the accused person, and another minor daughter of the complainant in FIR No.21/2018, also alleged raped by the accused person on her.
The above said FIRs were registered on different dates as complainants had filed the missing reports on different dates with regard to their minor daughters. Investigation revealed that the accused person/applicant herein had allured three minor daughters of the complainant in FIR No.20/2018 and one minor daughter of the complainant in FIR No.21/2018 and taken away them from the custody of their natural guardians.
The victims were later on recovered from the custody of the accused in Jammu at Qasim Nagar and two minor girls (name withheld) were also subjected to rape by the accused person.
Investigations culminated into challans in the above mentioned FIRs.
As a consequence cases were committed to this court for judicial determination. Principal Sessions Judge Reasi Kamlesh Pandit while rejecting the bail application observed that offence alleged to have been committed by the accused person is very heinous and are considered to be against the public at large and the court cannot shut its eyes so far as gravity of the offence is concerned and its impact on the society at large unless and until defence proves contrary to the result of the investigation. In the given facts and circumstances, this court is not in a position to come to the rescue of the accused (applicant herein) so far as background circumvented in the challan is concerned. (JNF)
