Additional Sessions Judge, acquits six accused in NDPS case

JAMMU, Dec 11: Additional Sessions Judge Jammu, Tahir Khursheed Raina, has acquitted all six accused persons alleged by the prosecution of carrying commercial quantity of narcotics in their vehicles. The prosecution alleged that on 27.12.2016 the SI Kamalpreet, sent a docket to Police Station Miran Sahib through constable Farman Ali , for registration of a criminal case. That when they were on duty at “Tunday Nihalpur” at about 9.00 PM (2100 hours) , a Maruti Car, type Alto, bearing Registration No JK02AD 8746, which was on way from Kalyan to Kairpind, on seeing police party stopped at about 20 mtrs away from Naka. Simultaneously, a Tanker bearing Registration No JK0AW 1633, which was also coming, stopped just behind the said car and on checking heavy quantity of Poppy Straw was recovered from both the vehicles. However, during trial, prosecution failed to prove its case and the Judge noted the various violations of the provisions of the NDPS Act. The Court said, “...The remedy cannot be worse than the disease itself. The legitimacy of judicial process may come under the cloud if the court is seen to condone acts of lawlessness conducted by the investigating agency during search operations and may also undermine respect for law and may have the effect of unconsciously compromising the administration of justice that cannot be permitted.”
The Court acquitted all the accused persons after hearing Adv Anmol Sharma appearing for the accused persons.
