Jammu, Dec 24: Principal Sessions Judge Udhampur Mohan Lal Manhas rejected the bail application of Yawar Ahmed son of Abdul Ahad resident of Kakran Ganie Kulgam, Tariq Ahmed son of late Ali Mohmed R/o Devsar Qazikund Anantnag , Nariender Singh @ Kaka son of Shankar Singh R/o Sukhi Karlai Udhampur and Anand Kishore son of Bhishan Dass R/o Jaganoo Udhampur who was booked under 8/15/29 NDPS Act after being arrested with psychotropic substances .
The accused persons were arrested by the Rehmbal police along with 122 kilogram commercial quantity poppy straw.
After hearing Public Prosecutor Inderjeet Sharma, Principal Sessions Judge Udhampur ML Manhas observed, that in this case charge sheet has already presented in the court and some witnesses had been recorded and if accused were admitted to bail at this stage, there is every apprehension that he may flee from the law and definitely win over the prosecution witnesses. Court further said that in view of clear embargo imposed by section 37 of NDPS Act are no help to accused. On these consideration and in view of aforesaid discussion , Court is of the considered opinion, that this is the fittest case ,where the bail sought not to be granted and accused too have failed to carve out a strong case for bails in their favor, Bail applications being misconceived under law are disallowed and rejected.
