EARLY TIMES REPORT

JAMMU, Jan 18: The National Human Rights Commission (NHRC) has recommended to the Chief Secretary, Govt of Jammu & Kashmir to pay monetary compensation of Rs 3,00,000 to the next of kin (NoK) of each deceased, who died due to the consumption of adulterated oral syrup/medicine.
The NHRC decision came after a social activist Sukesh C Khajuria lodged a complaint regarding the deaths of infants due to consumption of spurious drugs in Ramnagar area of Udhampur district in December2019,January 2020.
The Commission in its order issued today directed the J&K UT to provide a compliance report along with proof of payment be made available to the Commission within six weeks, positively.
Earlier, the NHRC had issued a show cause notices to the J&K government and also sought action taken report against “the delinquent officials, on account of whose negligence such incident had occurred, which could otherwise be averted due to their strict vigil”.
Sukesh C Khajuria in his petition to the NHRC had sought adequate compensation for the victims and their families and action against the negligent officials.
The NHRC in its earlier order has issued show cause notices to the Chief Secretary of J&K returnable within a month, found the state to be “vicariously liable for said negligence” and asked the J&K government as to why the Commission should not recommend payment of compensation of Rs 3,00,000 to the NoK of each deceased in the present case, who died due to the consumption of adulterated oral syrup/medicine and whose human rights have been infringed upon.
The NHRC observed that complainant Sukesh C Khajuria had alleged about the deaths of a dozen infants/children due to consumption of a particular spurious cough syrup in Ramnagar Tehsil of Udhampur district of Jammu and Kashmir during the month of December 2019 – January 2020. It is alleged that the incident happened due to negligence of the officials.
The complainant has sought for intervention of the Commission for action against the delinquent government officials and compensation to aggrieved families who have lost their children.
