NIA Court frames charges against Hizbul terrorists in Chander Kant Sharma killing case

JAMMU, July 5: Special Judge NIA Jammu Suneet Gupta today framed charges in much publicized killing of Chander Kant RSS activist against four Hizbul terrorists. The special judge framed charges against Nisar Ahmed Sheikh, Nisar Ahmed Butt, Azad Hussain Bagwan, Parvaiz Ahmed and Rustam Ali Bagwan u/s 302/307/392/109/120-B/34 of RPC, sections 18/19/39 of UA (P) Act.
On 9-4-2019 at about 12:30 hours, an input was received at police station, Kishtwar that some unknown terrorists had carried out attack on Chander Kant Sharma at OPD Block of district Hospital Kishtwar wherein constable Rajinder Kumar who was deployed as PSO with Chander Kant Sharma, an employee of District Hospital Kishtwar was killed on the spot and Sharma was severely injured and was airlifted to Jammu Hospital for further treatment. Later on, Chander Kant Sharma succumbed to the injuries.
During this terror attack, the terrorists took away the service rifle AK 47 of PSO Rajinder from the spot. The terrorists committed this terror act with an intention to revive militancy and to strike terror among the people of the area and thereby threaten the unity ,integrity and sovereignty of India. In this regard, a FIR No.67/2019 u/ss 307/ 302/ 392/109 RPC, section 7/27 A Act and section 13/17/20/23 UA(P) Act was registered with P/S Kishtwar and investigation was initiated .
Subsequently, in compliance with Order No. 11011/55 /2019/NIA dated 1-11-2019 passed by the Govt, of India Ministry of Home Affairs , this case was taken over by NIA and it re registered the case vide RC No. 06/2019/NIA/Jmu u/ss 302/307/392/109 RPC,section 7/27 A Act and 13/17/20/23 UA (P) Act on 2.11.2019. During the investigation, it reveals that some members of Hizb-ul-Mujahideen ( HM) a banned terrorist organization had conspired to strike terror in the minds of the people of Kishtwar by carrying out terrorist acts by targeting persons of particular community .
During the investigation, it revealed that the accused Nishad Ahmed Butt had given shelter to the HM terrorist Osama Bin Javed, Haroon Abbas Wani and Zahid Hussain at the hide out made at his home while these terrorists were in the progress of carrying out their terrorist activities as well as hiding themselves in order to evade their arrest after carrying out the murder of Chander Kant and his PSO Rajinder. This hideout was prepared by Nishad Ahmed and Rustam Ali.
The investigating agency had recovered some bunches of hair from the hideout at the residence of accused Nishad and the DNA of the said bunch of hair were matched with the DNA profile of Osama Bin Javed and Zahid Hussain as per the report issued by the Director FSL Srinagar. During investigation, it was proved that the accused persons had provided the logistics support to the HM terrorist Osama Bin Javed and Haroon Abbas for carrying out terrorist activities.
It is worthwhile to mention here that during the investigation of the present case, Osama and Zahid were killed during an encounter with the security forces on September 28, 2019 within the jurisdiction of police station Batote District Ramban. As such, the proceedings against Osama, Haroon and Zahid Hussain have been abated vide order dated 18-11-2020 after recording satisfaction about their deaths.
