Court directs DC Jammu to attach moveable property of MD Premier Hotel

JAMMU, Sept 3: Chief Judicial Magistrate Jammu Amarjeet Singh Langeh today directed Deputy Commissioner Jammu to attach moveable property of Suresh Soni S/o Manohar Lal Soni, Managing Director M/S Hotel Jammu Premier (P) Ltd, Residency Road, Jammu to the tune of amount awarded in the award under execution as mentioned herein above and submit compliance report by or before next date of hearing. It however is clarified that should respondent deposit an amount of Rs 68,460 (Rupees sixty-eight thousand four hundred sixty only) during execution of attachment warrant in question, in that eventuality District Collector (Deputy Commissioner), Jammu shall cause that amount to be received and deposited in this court for onward disbursement to petitioner. Court further clarified that in case attachment warrant remains unexecuted, in that eventuality coercive process against respondent be resorted to so that award under execution is meaningfully fructified.
The petitioner Jia Lal seeks execution of award dated 31.01.2015 passed by authority under the Payment of Wages Act (Assistant Labour Commissioner), Jammu by virtue of which petitioner was held entitled to claim of Rs. 68,460 under the Payment of Wages Act and respondent was accordingly directed to deposit said amount within 30 days before the authority supra for its disbursement to the claimant therein. When respondent failed to deposit the aforesaid amount with the authority concerned, an execution petition was filed under Section 15(5) of the Act supra by the authority concerned on 02.09.2015. —JNF
