HC directs Com Secy R&B, others to file fresh compliance report on contempt petition

JAMMU, Oct 1: In a contempt petition filed by the petitioner for not complying with the court order dated 18-12-2015 in OWP No. 1871/ 2015 passed by the court whereby the court directed the contemnors Commissioner Secretary P. W. D (R&B) Jammu, Chief Engineer P. W. D (R & B) and Executive Engineer P. W. D (R&B) to initiate steps for acquisition of the land utilized for the purposes of construction of road and assess compensation and pass award qua the portion of the land actually utilized for the construction of road to the extent of its involvement of the survey no. 126.
This process be initiated and concluded within a period of six months and compensation be disbursed to the petitioner in terms of the award. As per the details available with Early Times, when the matter came for the hearing, counsel for the petitioner Mohammad Irfan drew the attention of the court towards the court order dated 4-8-2021 where by the court directed the contemnors to file fresh compliance report by or before the next date of hearing failing which contemnor no. 3 shall remain in person. The counsel contended that my land has been taken by the department but in turn they are not paying me any compensation.
Justice Sindhu Sharma directed the counsel for the contemnors to file compliance report and put a specific query to the counsel for the contemnors why don't you not filed the compliance report, then the counsel submitted that on next date she would filed the compliance report. The counsel for the petitioner drew the attention of the court towards the writ court order dated 18-12-2015 whereby the contemnors have been directed to access the compensation qua the petitioner within period of six weeks but it's really astonishing that six years down the line since the passing of the court order the contemnors are not complying with the order as these contemnors don't have any regards for the court and adopting the contemptuous attitude by not implementing the court order which is really intriguing.
The court asked what about the statement of facts which has been field by the contemnors, counsel for the petitioner submitted that the P. W. D R& B department sent a communication to the revenue department for holding joint demarcation of the property in question but this is just time seeking process on one pretext or the other but on ground nothing concrete has been done so far and how much time will the contemnors take in implementing the court order. The court directed the contemnors to file fresh compliance report on next date of hearing and listed the matter for November 11.
