Govt can’t apply amended rules to pending selections, withdraw advertisement: BJP spokesman Advocate Sharma

Jammu, Feb 19: BJP spokesman, senior advocate Abhinav Sharma, on Saturday questioned the legality of J&K Government’s decision to withdraw the posts that were announced before October 31, 2019.
Talking to a news channel, Sharma said, “The government is saying that after October 31, 2019 when Reorganization Act came into force there was an amendment in reservation rules as the concept of domicile was introduced that’s why posts were withdrawn but at the same time the government is saying that all the candidates who were eligible for these posts when they were advertised will be given one time age relaxation .”
He said, “BJP’s stand has been loud and clear from the very beginning that its injustice with these youth. If the law has changed its prospective and cannot be given retrospective effect.
Whenever any new law is framed or existing law is amended its prospective and is applicable in future. When new posts are announced these rules can be applied there. But the government cannot apply amended rules to pending selections and withdraw the advertisement for the same,” he said.
Advocate Sharma said, “Another issue that has come to fore is that marks of interviews were more. Even if that’s the case the government could have issued a corrigendum that instead of 20 marks interviews will carry only 10 marks.”
