Giving teeth to Prevention of Corruption Act HC gives wake up call to Govt 12/11/2013 9:45:52 PM S Sabaqat Srinagar, Dec 11: The J&K High Court has directed government to expedite process to file response by December 30 about the process of amending J&K Prevention of Corruption Act Samvat 2006 in keeping with the recommendations made by a high-level committee headed by Chief Secretary. Hearing a Public Interest Litigation, the Division Bench of the court comprising Justice Mohammad Yaqoob Mir and Justice M H Attar reiterated the directions passed last month. "In compliance to order dated 13.11.2013 response has not been filed. The directions are reiterated with a further observation that the respondents shall expedite the process and to file the response by or before December 20," the court said. The CS-led committee had made recommendations after discussing various suggestions directed to be considered by the court in July this year. Among the suggestions include awarding six to twenty years jail to convicted person and making bail provisions stringent at par with Narcotic Drugs and Psychotropic Substance Act. Government has already conferred powers to the Additional District & Session Judges to function as Special Judge Anti-Corruption within their respective Jurisdiction. In another direction, the division bench also sought response about evolving a scheme for enabling poor girls and women to earn dignified livelihood. Earlier Secretary Social Welfare Department in its compliance report to the directions by the court said that there were 3,73,086 poor girls in the state. The officer also informed that there are about 13 centrally/state sponsored schemes for the welfare of the vulnerable and weaker sections of the society run by the Social Welfare Department. Out of them, the secretary said, 8schemes are purely meant for the welfare of poor women in different age groups. The Court passed the directions in a case titled Muhammad Amin Beigh v/s State and others. The District Magistrate Srinagar had slapped detention order under Public Safety Act (PSA) on Beigh for allegedly exploiting girls under the garb of providing them jobs. Beigh had challenged the order in the High Court. However, the Court dismissed his plea and subsequently passed series of directions to the government asking it to take steps to ensure rehabilitation of poor girls in the State.   Share This News with Your Friends on Social Network     Comment on this Story
