HC seeks personal appearance of CE I&FC over Pahalgam constructions | | | Early Times Report Srinagar, Apr 10: A Division Bench of Jammu and Kashmir High Court has directed Chief Engineer Irrigation and Flood Control (I&FC) to appear in person to explain as to why all five structures, identified by the department to come up in violation of court orders, have not been demolished. Hearing a Public Interest Litigation, a division bench of the court comprising Justice Mohammad Yaqoob Mir and Justice Hasnain Massodi directed the personal appearance of the Chief Engineer on next date of hearing listed in week commencing May 9. The direction by the bench followed submission by Advocate General and the Executive Engineer, who submitted that two of the five illegal structures have been removed while request for security was sent to the District Administration. However, he was unable to convince the court about the requirement of security when the two other structures were demolished without the security. The Division Bench on last date of hearing had observed after perusal of Compliance reports filed by the Chief Engineer, that flagrant violations have been done by five persons namely Ghulam Hassan Wani, son in law of Abdul Gaffar Wani of Anzulla, Anantnag, Ghulam Rasool Bhat son of Abdul Rehman Bhat of Anzula Anantnag, Zonal Educational Officer, Mattan through Tauseef Ahmad Dar of Vailnagabal, Mushtaq Ahmad Sathoo of Anantnag and Zonal Education Officer, Mattan. A Division Bench also directed concerned authorities to ensure that no construction activity is carried within 200 meters of river Lidder in Pahalgam district of south Kashmir. The Division Bench also granted eight weeks time to authorities for completion of "Draft Revised Master Plan" and "Land Use Plan" for Pahalgam. |
