DB upholds lifer to wife's killer

Jammu, Apr 10 : Division Bench of state High Court comprising Justice Virender Singh and Justice Janak Raj Kotwal upheld the life-imprisonment of Mohd Bashir who killed his wife for solemnizing second marriage.
According to police case that One Mohd Bashier has killed Zainab Bi who was married to him about 15 years ago. Out of their marriage, three daughters have been borne out. The relations between them became strained after two years of their marriage and the litigation between them was pending in the Court. Because of this reason, the victim was residing at her parental house for the last 4 to 5 months of the occurrence.
On April 17, 2007 Mohd Bashier saw the victim in bazar at Harni and he took her to his house and in the intervening night of 17th and 18thof April 2007, killed her mercilessly and buried her dead body at unknown place. On this information an FIR for the commission of offence u/s 302 RPC was registered and the investigation was commenced. The investigation came to the conclusion that the accused and the deceased were married about 15 years ago and the accused wanted to solemnize second marriage and he usually beats and tortures the deceased either on one pretext or the other.
He also alleges that false allegations of unchastity against the deceased.
After completion of investigation challan was presented and then Principal Sessions Judge Poonch Kishore Kumar after gone through the statements of prosecution witness including the statement of daughter of the accused, awarded life-imprisonment. Against the conviction awarded by the trial Court, accused preferred appeal in the state High Court. Division Bench after hearing Adv Anmol Sharma appearing for the accused whereas AAG Ravinder Sharma appearing for the state observed that the evidence of daughter of accused and the deceased and the only eye witness to the occurrence considering her to be the most truthful witnesses and that by itself is a sufficient piece of evidence pointing towards the guilt of the accused coupled with other attending circumstances. With these observations, Division Bench upheld the life-imprisonment awarded by the Trial Court.
