HC seeks personal appearance of DC Bandipora Constructions along water bodies 8/23/2014 11:42:03 PM Srinagar, Aug 23 : The J&K High Court has directed Deputy Commissioner Bandipora to appear in person on September 4 and file an affidavit, explaining whether any construction has been undertaken in violation the order banning all type of construction in the area falling within the Shiekhsar and Khushwansar lakes. Hearing a Public Interest Litigation (PIL), a Division Bench of State High Court comprising Chief Justice MM Kumar and Justice M H Attar directed nodal officer to produce record regarding the matter on next date of hearing on September 4. "We direct the Deputy Commissioner Bandipora to appear in person and file an affidavit explaining whether any construction has been undertaken in violation of the order dated 22.05.2013." The division bench has already directed implementation of ten recommendations made by a team of officers which was constituted to undertake inspection and submit a report to suggest the measures for saving the water bodies. The committee had recommended that the area of the two lakes be demarcated and all constructions there be banned with immediate effect. It had also recommended removing all the encroachments within the lakes, besides dredging out of the solid mass for restoring the water bodies. The panel also recommended preservation of the wetlands portion of the lakes as these were important part of the ecosystem and attract large number of migratory birds. While directing implementation of the recommendations, the division bench had observed that these directions were necessitate in view of order passed by the Supreme Court asking all the state governments that they should prepare schemes for eviction of unauthorized occupations of Gram Sabha, Gram Panchayats, Poramboke, Shamlat land and the same should be restored to Gram Sabha/Gram Panchayat for the common use of villagers of the village   Share This News with Your Friends on Social Network     Comment on this Story
