Court denies bail to two in 'gang rape' case | | | Jammu, Nov 17 : Principal Sessions Judge Poonch Jaffer Hussain Beigh has rejected the bail application of Maqsood Hussain and ShaheedIqbal who were facing trial in 'gang rape' case. Principal Sessions Judge Poonch Jaffer Hussain Beigh hearing the case observed that the charges have been framed against the accused Maqsood Hussain for offences u/Ss 376(1) (2) 363 RPC and against the accused ShahidIqbal for offence u/Ss 363,376, 109 RPC, established this fact that there are reasonable grounds for believing that the accusation against both these accused persons is prima facie true and they have not undergone detention for a period extending upto one half of the maximum period of the imprisonment specified for that offence under the law so the accused are not entitled to bail at this stage. With these observations Court rejected the bail application. As per police case petitioner-Hanifa Bi w/o MohdShabir R/o Mangnar-Poonch filed a written report at Police Station Poonch on 19/08/2010 therein alleging that on 18/08/2010 at 7.00 am her daughter who had left for her school, was kidnapped by accused persons. "Prosecutrix allegedly was forced to board a Tata Sumo bearing registration no. 3144/JK12, the complainant alleged further adding that accused had kidnapped her for illicit intercourse.(JNF) |
