Conversion of Agricultural land: DB issues contempt notice to 7 DCs | | | Early Times Report
SRINAGAR, Feb 13: A Division Bench of Jammu and Kashmir High Court has issued show cause to seven Deputy Commissioners, asking them as to why contempt proceedings should not be initiated against them regarding the conversion of agriculture land in the Kashmir Valley. In this regard, the division bench of the court comprising Justices Muzaffar Hussain Attar and Janak Raj kotwal asked registry to issue notices to the Deputy Commissioners of Anantnag, Pulwama, Srinagar, Ganderbal, Bandipora, Kupwara, and Shopian. “The authorities to file the reply to the show cause notice before the next date of hearing,” the division bench said It also termed the compliance report filed by the Deputy Commissioner Baramulla as mere “eye wash” and warned contempt proceedings against him over the failure to comply with its orders. In his status report, the DC has stated that illegal constructions have been demolished. After the perusal of the report, the bench observed that the Deputy Commissioner has not stated as to how much land and at which place it has been retrieved from the possession of the encroachers. The Deputy Commissioner, court said, has also not stated as to whether any encroachment from kahcharie land has been removed. “The Deputy Commissioner to ensure the compliance of the Court orders passed from time to time and remove encroachment from the kahcharie land and ensure that possession of the same is taken by the Revenue Department,” the Division bench said. “He is directed to continue with the anti-encroachment drive and remove all the illegal encroachments in his District,” the Division Bench said. The division bench also directed the Commissioner SMC, Vice-Chairperson SDA and vice-Chairperson LAWDA to ensure that no illegal constructions are raised in the areas which fall within their respective jurisdictions. “It is made clear that if any complaint is received about the raising of any other illegal construction, then the action for violation of Court orders will be initiated against them,” the court said. Meanwhile, the Divisional Commissioner Kashmir filed compliance report regarding removal of encroachment from ‘khacharie (grazing land). The Officer has stated that on receipt of the Court order (November 25), he issued instructions to all the Deputy Commissioner of Kashmir Division to file fresh compliance and status report. The Divisional Commissioner also stated that the Deputy Commissioner Budgam was directed to ensure removal of encroachment from Kahcharie land especially in the area of Gogo land within two days. It is stated that the Deputy Commissioner Budgam while continuing with the anti-encroachment drive removed encroachment of land measuring 2 kanals at Humhama. “We appreciate the work done by Deputy Commissioner Budgam and we hope and trust that he will continue with the anti-encroachment drive and will retrieve the other land from the possession of the encroachers,” the court said and asked the Deputy Commissioner Budgam to file fresh status report about the removal of encroachment and land which may be recovered from the possession of the encroachers, before the next date of hearing.
