Seniors bypassed, juniors promoted as SEs in R&B department
HC direction of quashing promotion order ignored

JAMMU, Feb 13: In a serious breach of norms and propriety, several juniors Executive Engineers have been promoted as Superintending Engineers (SEs), in the Department of R&B, depriving seniors their legitimate due.
The audacity of R&B department could be gauged from the fact that it had even ignored High Court direction of quashing the promotion order.
Sources informed Early Times that according to government order number 437-PW (R&B) of 2013 dated, 29/11/2013, Incharge Executive Engineers, Bachan Lal, Kushal Chand, Abdul Majid Khan, Tashi Chambal and ND Khawaja were placed as In-charge Superintending Engineers in R&B department.
As the promotees were junior to several others in the department as per the seniority list, some seniors engineers had filed an objection in High Court (HC) Srinagar wing, which in turn had quashed the order 437-PW (R&B) of 2013, as per judgment dated 30-12-2013 in the case titled Ghulam Jeelani Shah and Others vs state of J&K and others (SWP No. 2361/2013; CMP No. 3831/2013.
Sources said that after the lapse of more than one year, same government order has not been quashed by the R&B department and the promotees have still been working as In-charge Superintending Engineers.
Sources alleged that the problem in promotion began when the department had promoted a ND Khawaja as in-charge Superintending Engineer in 2013. "When ND Khawaja was promoted as In-charge SE, even though his name was not falling in the final seniority list of AEEs issued by R&B according to order number 312-PW (R&B) of 2012 dated, 13/8/2012 ", sources said, and alleged that Khawaja was simply AE, when he was promoted as in-charge SE.
Sources further alleged that though ND Khawaja was promoted from the category list but during his promotion, several other senior officers, having category certificates namely Roop Lal, Prakash Chand Tanuj and Manzoor Hussian were also ignored by the department.
They further informed that Bachan Lal, Khushal Chand, who were promoted as Incharge SEs were at serial number 438 and 439 in the seniority list of department issued as per order number 312 PW(R&B) of 2012, dated 13/8/2012 and had been working as Incharge SEs but the officials at serial number 339 Rajinder Kumar Sapru, Showkat Hussian Koul (Sr. no. 133), Sunil Kumar Gandotra (134), Abdul Majid Shabnam (136), Devinder Kumar Khanna (137), Rajesh Kumar Gandotra (138) and several others most seniors were still working as in-charge Executive Engineers.
Sources said that against 32 posts of Superintending Engineers in the department, 18 in-charge SEs were already in place, out of which 11 were from the reserved category including Des Raj (SC), Sita Ram Dogra (SC), Bishan Dass Pangotra (OSC), Bachan Lal (SC), Kushal Chand (SC), Abdul Majid Khan (ST), Tashi Chambal (ST), Rashid Ahmad Fani (RBA), ND Khawaja (RBA), Bashir Ahmed (RBA) and Omar Farooq (OSC).
Sources further alleged that department has formulated another list of nearly 10 officers, majority of them from the reserved categories, who were proposed to be promoted as In-charge Superintending Engineers on the 14 vacant posts of SEs.
Sources alleged that some officers in the department have been giving wrong interpretation of HC judgment to the department, just to appease the beneficiaries, who were promoted during previous coalition government, at the expense of genuine senior engineers, who were already confirmed as AEEs , and were much senior to persons-holding posts on stop gap arrangements and this ad-hoc promotion of AEE level, EX En level was not regularized till date.
They further said that according to another HC judgment, the Chief Secretary was reportedly asked to get final/tentative seniority list be framed and to stop ad-hoc arrangements, which has become a common feature in the department, but so far nothing has been done .
