Impugned KAS seniority list: GAD goes out of way to help 'favourites'

Jammu, Apr 23: The state government is going out of way to help 'blue-eyed' KAS officers who were given out-of-term promotions in disputed seniority list of KAS officers of 1999 batch.
After 1984, KAS officers were selected in 1999 and the batch was allotted different feeding departments by the Public Service Commission as per suitability and merit.
Meanwhile, the High Court on Thursday clubbed all the petitions of KAS officers including the contempt petition filled by the aggrieved officers of 1999 batch and fixed the next date of hearing on April 29. The Supreme Court has fixed two month deadline for the High Court to dispose of the petitions and get the order of single bench implemented.
The previous government led by Omar Abdullah through General Administration Department headed by him framed tentative seniority of 1999 batch officers as per norms and the officers were placed in the seniority list as per the slots available in the respective feeding services.
There were few violations like the officers were shown induction year two to three years later than the years they were otherwise eligible despite availability of the slots. For example, the officers of CD & NES were allotted inducted year 2007-2008 despite the availability of slots in year 2004. Same is the fate of other feeding service officers.
The objections were filed by the officers and instead of addressing the genuine objections of the officers, the then officers heading the GAD went ahead with its agenda by adopting dubious methods and placed its favorites at positions at which they were not eligible.
Officers of Secretariat Services whose slots were not available were not only inducted along with the same batch in 2008 in one go but also placed over and above the officers who were otherwise eligible for induction in 2004-2005.
Representations after representations to GAD bore no result and the aggrieved officers ultimately knocked the door of court. The aggrieved officers fought for two years to get the wrong done in previous government rectified.
Accordingly, a single bench of the High Court ordered that 49 officers who had been inducted into KAS through dubious methods without availability of slots be placed at the bottom of the seniority list and the government may consider to allow year of induction into KAS as per standing norms of GAD which inter alia mean to allot induction year as per availability of slots.
But GAD, with scant regard to the directions of High Court, continued to further its agenda of promoting its 'blue-eyed' officers and posted them at coveted positions by pleading before court that these officers are posted at higher positions on officiating basis.
Last year, the GAD then pleaded before the court that Parliamentary and Assembly elections are due and the continuance of these officers on officiating basis is very much required for smooth conduct of elections. The High Court ordered that these arrangements will cease to exist once the elections are over.
Now, as the Parliamentary and Assembly elections are over and the new government has taken over, instead of complying with the directions of High Court, the GAD is brazenly following the agenda of previous government by benefitting the 'blue-eyed' officers.
By pleading before court for continuance of officiating arrangements for the 'blue-eyed' officers, the government has put a question mark on the efficiency and services delivering of over 100 KAS officers who are very much eligible and efficient to handle sensitive postings.
It may be mentioned that the aggrieved KAS officers whose career prospects have been spoiled by the previous government, knocked the door of Supreme Court. The apex court Highest directed the state government to implement judgment of the single bench of J&K High Court which states that selection grade be given to all the officers of 1999 batch and place 49 ineligible KAS officers at the bottom of the list and consider allotment of induction year as per rule 15(4).
The aggrieved KAS officers while talking to Early Times said that the government threw High Court and Supreme Court directions to the winds and placed 10 KAS officers in Special Scale.
"The release of selection grade and subsequent promotion of 10 KAS officers of 1999 batch to Special Scale amply shows that government has no regard for the court directions and is free to do anything," said an aggrieved KAS officer wishing anonymity.
He said that the aggrieved KAS officers of 1999 batch whose number is over 100, have been running from pillar to post, pleading that the rules framed by GAD be implemented but government is all out to give benefit to its 'blue-eyed' officers come what way.
"We have no doubt that Chief Minister Mufti Mohammad Sayeed who is known as a strict administrator will rise to the occasion and get the things in right direction," the officer added.
