Court denies bail to Army Cop in rape case

JAMMU, Sept 22: Principal Sessions Judge Udhampur RS Jain rejected the bail application of one Sudesh Kumar an Army Cop who was allegedly involved in rape case. Accordingt o the case that FIR No.407/2014 was registered in P/S Udhampur against accused on the complaint filed by prosecutrix and in the written complaint it has been averred that complainant/victim is 23 years old and unmarried. That in 2008 when the complaint was 17 years old, she was assured by accused that he would marry her when he gets selected in the security forces and thereafter there was a continuing relationship between the complainant and accused who exploited her in emotionally and physically and even raped her by playing with her emotions because she had fallen in deep love with the accused. It is further that accused introduced her to his parents at Reasi and informed them about to desire to marry her. Accused had also assured the parents of the victim that he would marry her. After the accused after selection in the army remained inconstant touch with the complainant and whenever accused came to Udhampur he raped her on the pretext of marriage and on account of the assurance of marriage the victim maintained a physical relationship with the accused for six years but now accused have got engaged with one Jyoti Devi and thus accused is guilty of offence u/s 376/420 RPC. On completion of the investigation, challan for offence u/s 376 RPC was presented against the accused in court by the I.O. The accused has been charged for offence u/s 376 RPC. Principal Sessions Judge Udhampur Mr. RS Jain after hearing both the sides observed that prosecution is leading evidence and the statement of the prosecutrix is yet to be recorded. Looking to the serious nature of the allegations levelled against the accused. With these observations Court rejected the bail application. (JNF)
