Husband's killing: Life-imprisonment awarded to wife, paramour

Jammu, Sept 23: Additional Sessions Judge Rajouri Khalil Ahmed Choudhary today awarded life-imprisonment to Shahnaz Begum w/o Mohd Farooq and her alleged paramour Mohd Hanief for killing Mohd Farooq. After hearing both the sides, the court observed that the nature of the crime committed and the manner in which it was committed can be decisive factors to decide as to whether corrective measuring should be adopted or deterrence based approach would be befitting. Keeping in view that accused does not have any previous criminal record, their age, the manner in which the murder was committed, the Court is of the view that they does not deserve the extreme penalty of death. Thus keeping all the factors in view, each of the accused while being convicted under section 302/34 RPC and awarded for life and fine of Rs. 5000/- for commission of the offence. According to the police case is that on 04-01-2007 the police of P/S Manjakote received an information through reliable source that the Mohd Farooq s/o Noor Mohd of Gambhir Mughlan was murdered by some persons with criminal intention and the dead body was kept behind the bushes and stones after digging the ditch at Gambir Mughlan Morha Chanj. During investigation the statement of the legal hears and other witnesses were recorded u/s 161 Cr.PC and the accused Mohd. Hanief S/O Abdul Hussain, Mst Shahnaz Begum, and Nissar Ahmed S/O Mohd Yousaf caste Mughal R/O Gambir Mughllan were taken into custody for investigation.
It was found after recording the statements of the witnesses and other investigation that the deceased Mohd. Farooq was married with Shahnaz Begum d/o Mohd Yousaf of Gambir Mughlan 9/10 years ago but she was not willing to marry with the deceased.
The accused Shahnaz Begum and Mohd Hanief developed illicit relation with the passage of time and remained up to the arrest of the accused. (JNF)
