2 murder accused get life imprisonment

Kishtwar, Sept 23: Additional Session Judge, Rajouri, Khalil Choudhary has awarded life imprisonment to murder accused -- Mohammad Hanief, son of Abdul Hussain, and Shahnaz Begum, wife of Mohammad Farooq of Gambhir Mughlan, for murdering Mohammad Farooq, son of Noor Mohammad Mughal, also a resident of Gambhir Mughlan, and burying the body behind bushes and stones after digging a ditch at Morha Chanj.
During the trial of the case, the statement of the legal hears and other witnesses were recorded under section 161 of CrPC and the accused and the weapon of the offence (axe), one shawl and a bedsheet were also recovered.
It was found after recording the statements of the witnesses that Mohammad Farooq was married with Shahnaz Begum, daughter of Mohammad Yousaf Mughal about 9-10 years before his murder but she developed illicit relations with the passage of time with Mohammad Hanief. The villagers and other community members came to know about their illicit relations and they arranged biradri panchayats a number of times and asked them to mend their behaviour but they did not act upon the advice. The members of the biradri even boycotted them and accordingly the relation between the deceased and his wife became inimical and both started quarrelling with each other.
The victim who usually remained outside of his house and use to come home on Saturday and the accused Shahnaz Begum was well aware about the schedule of the visits of the deceased at home and one day the accused Shahnaz Begum got an opportunity to kill her husband along with her paramour. The body of the victim was recovered after 18 days of commission of crime, ie on January 4, 2007.
After hearing both the sides, the offence under section 302/34 of RPC was proved against Hanief, Shahnaz Begum and minor Parveez Ahmed against whom separate challan was presented before the competent court.
The judge, while awarding the sentence to both the accused, stated that the facts and the evidence do not suggest that it was a diabolical murder, added that the murder by itself is a serious crime but the manner in which it was committed and the motive behind the murder do indicate that it would not fall within the rare category of the cases. He stated that the accused do not have any previous criminal record so keeping in view their age, the manner in which the murder was committed by them and all other factors, I am of the view that they do not deserve the extreme penalty of death. So taking all the factors in view, each of the accused while being convicted under section 302/34 RPC is sentenced to a simple imprisonment for life and fine of Rs 5000 for commission of the offence under section 302/34 RPC. In case of default in payment of fine, the accused would undergo a further imprisonment of one month. Both the accused were already in jail for the last seven years. The case file was submitted to the high court at Jammu, through Registrar Judicial, for further orders.
