Encroachments on Nullah allegedly by Former Revenue Minister
ERA files Status Report in HC

Jammu, Feb 2: In the much publicized writ petition seeking demolition/removal of encroachments made by Former Revenue Minister Raman Bhalla and others on the Nullah /Drainage adjoining Satyam Resorts, Village Deeli, Jammu, today the Chief Executive Officer of Economic Reconstruction Agency (ERA) filed the status report in the High Court in terms of the directions issued by the State High Court vide its order dated December 23, 2015.
In the status report it is divulged that ERA has no Revenue Wing, nor is the Custodian of any Revenue Records. As such it is not possible to comment on the title of the land in the stretch under reference. The status report further says that the quantum of encroachment, if any, can be determined by the department having full details of ownership of land under reference. The ERA has also attached the site plan indicating the detailed factual site position.
Justice Tashi Rabstan of J&K High Court on December 23, 2015 after hearing this matter had passed a detailed order and had impleaded Chief Executive Officer J&K ERA as a necessary party and had directed him to file latest status report with regard to alleged encroachments highlighted in the writ petition.
In the petition it has been submitted that the Former Revenue Minister Raman Bhalla has constructed a palatial house adjoining Satyam Resorts and has also raised a huge bund on the Nullah coming from Trikuta Nagar, Jammu for making alternate pathway/entrance to his residence when according to the approved building plan of JMC the entrance is from different side.
It has also been alleged that the said alternate way was made by encroaching the Nullah by putting slab on it which is not permissible in terms of J&K Water Resources (Regulation & Management) Act 2010 and the petitioner has prayed that directions be issued to the Commissioner/Secretary Housing and Urban Development Department, Divisional Commissioner Jammu, Deputy Commissioner, Jammu, Commissioner JMC, Jammu and Chief Engineer UEED to perform their statutory duties by removing the encroachments made on Nullah by Former Revenue Minister and other high profile encroachers. --(JNF)
