SIC seeks list of contractual lecturers from CEO Baramulla

Baramulla, Dec 22: State Information Commission (SIC) has directed the Chief Education Officer (CEO) Baramulla to provide the list of contractual lecturers engaged in various Government run Higher Secondary Schools of the district recently. The information was earlier denied by CEO when the same was sought under Right to Information Act (RTI) by an information seeker.
Details available with Early Times reveal that RTI application dated 12.05.2018 was filed by one Sheikh Irshad Rashid an advocate by profession seeking information from Public Information Officer (PIO) / CEO Baramulla relating to amount recovered/received from candidates who applied for engagement as contractual teachers on academic arrangement basis pursuant to advertisement dated 09.02.108 and also the list of selected candidates for District Baramulla. Thereafter, he filed First Appeal on 03.07.2018 with First Appellate Authority (FAA) in the Directorate of School Education Department, Kashmir (DSEK)
Subsequently, Advocate Sheikh Irshad filed 2nd appeal before the State Information Commission (SIC) on 25.09.2018 contending that the applicant did not receive any information from CEO Baramulla within the specified period. He also submitted that though he received a notice from the FAA DSEK for appearing before him for case hearing , but the said appeal was not finally disposed of by the First Appellate Authority (FAA). Appellant urged upon SIC that necessary directions be given to the CEO / PIO to provide information to him.
The appeal came up for hearing before Mohammad Ashraf Mir , Information Commissioner JK SIC on 14.12.2018. The appellant as well as the PIO/CEO Baramulla were present in person. The FAA (DSEK) filed a counter statement dated 11.10.2018, received in the Commission on 15.10.2018, submitting thereunder that both the appellant as well as the PIO failed to appear before the him on different dates fixed for hearing and the First Appeal was disposed of with a direction to PIO/CEO Baramulla to provide pending information.
The PIO/CEO Baramulla also filed a counter statement informing thereunder that in response to the RTI request, information comprising of 9 documents bearing part of the information was furnished to the appellant vide communication dated 26.05.2018. As per the counter statement the appellant was intimated by CEO Baramulla that the list of engaged lecturers containing 175 pages could be provided to him after he deposited the fee required under the Act. The CEO/ PIO further submitted that the appellant was again informed vide communication dated 18.07.2018 to deposit the required fee and get the list of engaged candidates. However, the appellant did not deposit the required fee for collecting the balance information.
