| Accused discharged in infamous theft case | | | EARLY TIMES REPORT
KATHUA, Oct 3 : The Court of Judicial Magistrate First Class, Kathua Renu Dogra discharged all the accused persons in the infamous theft case, State Vs Munna Ramadan Rashid Saleh & Others, by Jordan nationals committed in Kathua, vide decision dated 27/09/2012.The Kathua Police has registered a case under section 380/201/34 RPC on the complaint of a Jeweler Deepak Parkash under FIR No.289/2012 and after investigation filed the challan on 13.08.2012 in the above said court. After hearing the Prosecuting officer and Defense counsels including Advocate Atul Singh Andotra, Advocate Sunil Singh, Advocate Rakesh Thakur and Advocate Saurav Mahajan the court observed that the prosecution has failed to prove prima facie case against the accused persons and the charge sheet against them is groundless. The court also came to conclusion that if the prosecution challan is taken as unrebutted the conviction will not entail after the whole trial because the Investigation officer in the case has put forth two different stories incorporating the above offence as he has investigated the case in a very casual manner. So the challan of the prosecution is dismissed and accused persons in the court are discharged in the above mentioned case and they are set at liberty in the open court. Also their personal and surety bonds shall be discharged and their release order shall be made absolute after the period of appeal is over. The prosecuting officer however submitted before the court that he intended to file revision against the above said order so the passport of the accused persons who are foreigners, be not released till he files revision otherwise they will leave the country and thereafter his revision petition will become infructuous. The court after considering the plea of prosecution given time to file revision till 5th of oct.2012 and thereafter passports seized by the police shall be released. |
