| Shopian Rape Case: Bar Denies Legal Aid to Accused | | Family seeks justice on fast trial basis | | Javaid Naikoo Shopian, Jan 5: In what can be seen as a noble gesture and a humanitarian move in support of the rape victim, Bar Association Shopian has decided not to provide any sort of legal assistance to the accused Shahid Ahmad Wani in Shopian rape case. "It was decided in the meeting that nobody will plead the case of accused in the case. The decision was taken on humanitarian grounds.Bar Association Shopian also strongly condemns such a brutal and shameful act,"said M.Y Bhat,President Bar Association Shopian. He also said that if any advocate of district Shopian tried to plead the case on behalf of accused Shahid Ahmad Wani,his registration with Bar Association Shopian will be terminated and he/she will not be allowed to enter the Court complex for life time. Pertinently, the family and rape victim herself,Rumaisa (name changed) of Zawoora Shopian wanted Chief Minister,Omar Abdullah to intervene in the matter and provide justice on fast trial bases. "I am not the only victim of this brutality,….today it is me, tomorrow it can be anybody else, if it is me a daughter of a poor father,it can be a daughter of a high profile person tomorrow", said Rumaisa ,lamenting that if law and order exists in this country, I should get justice without politicizing this issue. Post Delhi gang rape outrage across the country, even as Jammu and Kashmir government is working out on severe punishment of hanging and imprisonment till death for rapists, the victim is hoping against hope that speedy trial be ensured in her case as also in other cases which are pending. In this connection Law Minister Ali Mohammad Sagar along with authorities in Law Department convened a meeting few days back to discuss the amendments in existing law to have stringent action against the cases of sexual offence. "Capital punishment in cases of gang rape and rape of a minor and such cases should be made non-bailable like those arrested under the Prevention of Terrorism Act and Narcotic Drugs Prevention Act," Advocate General Ishaq Qadri told reporters. |
