| Court acquits accused in murder case | | | EARLY TIMES REPORT Jammu, Jan 5 (JNF): Principal Sessions Judge Jammu MK Hanjura acquitted one Naresh Kumar as prosecution utterly failed to prove its case. According to the police on October 18, 2009 Subash Matoo (the deceased) proceeded along the road to collect garbage in a cart, on reaching near foot-bridge situate at Ward No 8 Kathua, the accused Naresh Kumar picked up a quarrel with the deceased. The accused took out the digging tool (kahi) from the cart of the deceased with which he inflicted several blows on his head as a consequence of with which he fell down. He was shifted to District Hospital where he succumbed to injuries. Police registered a case u/s 302 RPC and after completion of investigation challan was presented in the court of law. Sessions Judge Jammu MK Hanjura after hearing Public Prosecutor Ravi Kumar Gupta appearing for the state and Adv Arvind Salathia appearing for the accused person, observed that there is no evidence against the accused on record from the appreciation of which it could logically be concluded that the accused committed the crime imputed to him and further observed that prosecution has utterly failed to bring the guilt of the accused home to him and acquitted the accused. |
