| Court acquits accused as prosecution witnesses contradict each other | | | early times report Jammu, Jan 15 (JNF): Principal Sessions Judge Samba Kartar Singh today acquitted Tafazul Ahmed & Sajid ullah Laway Residents of Natipora, Budshah Nagar from whom a charas more than 700 gram was recovered. According to the police case on July 13, 2011 During Naka a car came from Kathua side at 6.30 PM which was stopped and on enquiry its driver disclosed his name as Tafazul Ahmed and the 2nd person sitting in the car disclosed his name as Sajid ullah Laway. He became suspicious that they have some intoxicants drugs in their possession, as such, he took the consent of the accused as to whether they wanted to be searched in presence of Police Gazetted officer or before a Magistrate. They gave their consent that they be sear-ched before the Magistrate who was summoned on the spot on telephone and they were searched in his presence. During search Charas weighing 60 grams, cash Rs. 45,000/- and one Nokia Mobile were recovered from the accused Tafazul Ahmed whereas 50 grams Charas and Rs. 370/- in cash were recovered from accused Sajid ullah Laway. One plastic envelope was also found under the seat of the Car from which 700 grams Charas was recovered. He took the sample of Charas for chemical examination and seized the Charas. He sent a docket to the Police Station where case FIR No. 171/2011 for the commission of offence falling under section 8/20 NDPS Act was registered against the accused and after investigation the final report has been submitted in this court. Principal Sessions Judge Samba Kartar observed that prosecution has failed to prove the guilt of the accused beyond reasonable shadow of doubt and as such, they are acquitted of the charges framed against them. |
