J&K Govt's transfer policy goes wrong; rules bent for political, personal reasons

Jammu, Feb 22: For purely political and personnel reasons, State Government seems to be working overnight to violate much touted transfer policy announced by it in the year 2010. GAD has been so far dancing to the tunes of Ministers, MLAs and MLCs. Officers are shifted from one place to another without following this transfer policy in toto. Announced vide Cabinet decision no. 156/12/2010, Dated 27-7-2010, the policy on the transfer and posting of Government employees was made applicable vide Government Order No. 861-GAD of 2010 Dated 28-7-2010. But now this policy is a piece of paper and has no relevance for those who matter in the corridors of power.
Chief Minister had then directed all the administrative secretaries and the heads of the departments to give effect to new policy immediately in the interest of administration and ensure strict compliance. All Government departments had been asked to maintain complete database on transfers and postings of employees for effective implementation of the transfer policy. A cursory look at the departmental websites explains the vagueness of this first postulate of the much hyped transfer policy.
Most of the departments are yet to prepare complete database of the employees and have failed to identify employees who have either completed the tenure fixed for posting at a particular place. The transfer policy envisaged that while affecting the transfers, the eligibility and suitability of the concerned employees and the interest of Government work shall be given the utmost priority. The convenience of the employees may also be considered provided it does not affect the interests of the Government work.
None is followed strictly in any of the departments. Postings was to be made on a rotational basis to sensitive and non-sensitive posts and every department particularly the Engineering and Finance Departments had been asked to identify sensitive and non-sensitive posts and evolve a roster for posting of officers. Infact, none of the departments have been able to make the postings rotational due to the excessive interference of MLAs, MLCs and Ministers.
Physically challenged persons were to be given convenient posting subject to availability of a post but there are innumerable cases of these persons being made to move from one place to another for their proper adjustment. Chief Minister had vehemently stated that orders once issued must be strictly complied with and if it is considered that any order requires modification for some compelling reason, it shall be done only after obtaining approval of the next higher authority.
However, around 50 top officials which include Deputy Commissioners and IAS officers have got their orders modified and preferred choice postings over the ones for which orders were issued by the State Government. Even the orders issued during the Cabinet meetings have in several cases not been complied with. Ministers have been violating this main clause of the transfer policy with impunity. And as far as reversal of transfer orders is concerned, which had been asked to be made a very rare event and to be resorted to only in exceptional cases for which reasons shall be recorded in writing has become routine. Transfer orders are reversed within minutes and seconds of the same being issued by GAD.
A calendar was to be maintained for transfer. Transfers shall ordinarily be ordered in the first month of the financial year i.e. in April every year excluding the transfer of the teaching staff and transfers to Ladakh region. However, transfers take place through out the year and especially in some departments, it has become a matter of routine.
Minimum tenure of a Government employee on a post shall be two years and a maximum of three years was to be maintained at all cost. But neither is the minimum tenure clause obeyed nor is the maximum tenure taken care of. With Chief Secretary Iqbal Khanday, an official said that the transfer policy is likely to see thorough implementation.
