| Failure of reply within week, Principal GMC shall cease to function: HC | | | Et Report
Jammu, Aug 22: In a petition filed by Dr Indu Koul seeking direction to State respondents not to promote Dr Shashi Gupta presently Incharge Principal Government Medical College (GMC) Jammu, Justice Ali Mohammad Magray Thursday granted last opportunity of one week to respondents to file reply, failing which Dr Shashi shall cease to function on his present post.When the petition came-up of hearing senior advocate UK Jalali appearing for the petitioner submitted that respondents have not implemented the order passed on 3 June 2013 whereby the Court had directed respondents to file objections within six weeks with liberty to counsel for the petitioner to file rejoinder within two weeks. Jalali submitted that direction was passed with the intention to finally settle the matter as arrangement made by the Government appointing Dr. Shashi Gupta as Incharge Principal GMC is in violation of the rules and judgment of the Division Bench. He also pleaded that the Court cannot allow the arrangement being de-horses the rules and the law. Advocate WS Nargal appearing for Dr Gupta submited that due to unavoidable circumstances he could not file the objections in compliance of order passed by this Court. Upon this the Court observed that the official respondents have also chosen not to file reply and Deputy AG ZS Wattali appearing for the state seeks time to file reply. Justice Magray after hearing both the sides granted one weeks' last opportunity to respondents to file reply, failing which Dr Gupta shall cease to function as Principal GMC Jammu. (JNF) |
