| 2 years RI, fine to Branch Post Master | | Misappropriation of over Rs 7 lakh | | Jammu, Sept 23: Special Judge CBI Court J&K Jammu Kaneez Fatima today awarded two years rigorous imprisonment and fine Rs 2 lacs to Mohd Shafi Shan then Branch Post Master Gool who had misappropriated Rs 7, 40, 000/-. According to the CBI, a written complaint dated November 13, 2006 from Rattan Lal Superintendent of Post Offices, Udhampur was received alleging therein that on receipt of information about the fraud taken place at Post Office, Gool. During the enquiry by Sub Divisional Post Offices, Batote, it was revealed that in the enquiry report dated October 20, 2006 that Mohd Shafi Shaan, then Branch Post Master Gool had issued various receipts of Telephone Revenue Collection amounting Rs 7, 40, 166/-. On this complaint CBI registered a case u/s 409, 477-A RPC and 5 (1) (c) r/w section 5(2) J&K PC Act Svt 2006 was registered and after completion of investigation challan was presented. Special Judge CBI Court J&K Jammu Mrs. Kaneez Fatima after hearing SK Bhat Senior Public Prosecutor for the CBI whereas Advocate ML Thusoo appearing for the accused persons observed that the accused is found guilty of offences punishable U/s 409, 477-A RPC and 5 (1) (c) r/w section 5(2) J&K PC Act Svt 2006 and he is convicted accordingly, since the accused had deposited considerable amount of Rs 5, 74, 000 during the enquiry conducted by employee of Post Office and before the registration of case and awarded two years rigorous imprisonment on each section and fine Rs 2 lacs which shall be supplement the substantive sentence. Court further ordered that if the amount of fine be not deposited the same shall be realized from the estate of the accused. (JNF) |
