BOPEE Scam: HC asks CB to speed up pace in reaching to all culprits
Declines to restrain media reporting, warns against politicization of probe

Srinagar, Dec 3: In a much publicized Common Entrance Test (CET) conducted by the Board of Professional Entrance Examinations (BOPEE), Scam Jammu and Kashmir High Court today asked Crime Branch, the investigating agency to "keep pace" in reaching to all culprits so that the 'shaken' confidence of the public is restored. In its order court declined to restrain media reporting and warned against politicization of probe. Hearing a suo-moto Public Interest Litigation, a Division Bench of court comprising Justice Mohammad Yaqoob Mir and Justice Muzaffar Hussain Attar expected the probing agency Crime Branch (CB) to communicate details with BOPEE regarding beneficiary candidates. The direction the court also followed a perusal of a status report filed by the Crime Branch in respect of its investigation into case (24/2013) for commission of offences punishable under section 5(1)(d) read with section 5(2) P.C act and 420 RPC. During the hearing Crime Branch submitted that investigation is in progress and reflected detailed money transaction of the aspiring candidates namely including Shafiq-ur-rehman, Amira Shakeel, Mustaq Ahmad Lone, Khursheed Ahmad Dar, Bazila Bilal Vaid, Naveed Ahmad, Yasir Yousuf Dar and Yasir Yusuf Hajam. The Crime Branch also submitted that links of these 16 candidates are also under investigation. After going through submission of probing agency, the court observed that there is good number of candidates whose credentials are still under probe, whose names have not been divulged rightly so, because the investigating agency has to reach to the plot of the crime. In another direction, court directed the investigating agency to collect details of four accused regarding their movable and immovable property including those of their dependant family members."The four persons and their dependent family members till further orders from the court shall not in any manner, create any third party interest visi-a-vis property," the court said. The bench also directed that the report of enquiry, as had been initiated by the government separately and concluded, shall be produce before it in a sealed cover on the next date for perusal of the court. Earlier the court warned against "politicization" of the investigation by Crime Branch, observing that it will be otherwise hijacked the real cause of a sensitive matter. Besides this, court declined to restrain media from reporting the CET/BOPEE Scam, observing that the press is "doing its job." "While the Court doesn't allow media trial, yet it cannot stop media from reporting. It is because of media that court took cognizance in this case," the court added.
