| TSO files contradictory affidavit, Director CA&PD directed to probe | | | Sumit Sharma
Jammu, Dec 3: Director Consumer Affairs and Public Distribution (CA&PD), has been directed by State Information Commission to probe the veracity of the ration card issued in favour of one Reeta Devi wife of Sohan Lal, further directing him to take appropriate action against Tehsil Supply Officer (TSO) Samba namely Sahil Sharma under service rule applicable to him for filing contradictory oath in affidavit before State Information Commission.
The direction came on the complaint filed by Kovid Khosla, advocate J&K High Court, who in his complaint to SIC alleged that Anshu Mali ,Assistant Director (CA&PD) who happens to be the PIO has failed to provide the requisite and correct information within prescribed time as sought by him. He in his RTI query sought information regarding photocopy of the D form of one Reeta Devi w/o Sohan Lal of Kalwal, Samba for the year 2008-09 and photocopy of the APL ration card register pertaining to her.
The PIO/Asst Director, CA&PD Samba vide office No ADCAPD/S/2013-14/287-88 furnished unsatisfactory information to the information seeker which induced him to prefer 1st appeal before Director, CA&PD, Jammu, however, feeling aggrieved of the order No 169/G/RTI/Appeal-22/2737, by Director CA&PD who happens to be FAA , the complainant filed 2nd appeal before the Commission. The Commission directed PIO and TSO Samba to remain personally present along with office record on due date, with special direction to TSO Samba to file affidavit in support of his contentions and accordingly the directions were complied upon.
However, after going through the records the Commission observed, " Perusal of the contents of the affidavit as well as the information furnished by the TSO Samba vide office No TSO/S/13-14/1037 reveals that the APL Ration Card register, the name of the Reeta Devi w/o Sohan Lal r/o Kalwal, Samba having Ration Book No 426042 figures which is self contradictory viz-a-viz the information provided by the TSO Samba wherein he has stated that as per office record available no Ration Card stands issued in favour of Reeta Devi. The TSO Samba has further submitted in the affidavit that name of Reeta Devi stands included in the Ration Card issued on the name of Thoru Ram, her father in law bearing book No 429479 mentioned at Serial No 229 of village Malani on the basis of surrender certificate produced by Reeta Devi issued by TSO,CA&PD Hiranagar. Thus, the information provided to the information seeker and statement made on oath in the affidavit by TSO Samba is self contradictory and needs to be inquired by Director CA&PD, Jammu who shall fix up responsibility of the official concerned for appropriate action under service rules applicable to TSO Samba." |
