DB restrains employees of Home from working
'Sexual exploitation' of mentally challenged girls

JAMMU, Dec 3 : In a letter turned Public Interest Litigation filed by differently abled person (visually handicapped) practicing Advocate Suraj Singh seeking in-depth/thorough investigation in the infamous sexual exploitation of mentally challenged girls at Rotary Inner Wheels Home at Channi Rama Jammu, today a Division Bench of State High Court comprising Chief Justice MM Kumar and Justice Hasnain Massodi after hearing Advocate Sheikh Shakeel Ahmed with Adv Suraj Singh appearing for the PIL and Senior Additional Advocate General Gagan Basotra appearing for the state, restrained the persons/employees working in Rotary Inner Wheels Home Channi Rama Jammu, whose names figured in FIR NO 183/2013 of P/S Trikuta Nagar Jammu.
When this much publicized PIL came-up for hearing, Sushma Chauhan, Additional Deputy Commissioner Jammu who is presently managing the affairs of the Home appeared in person as per the directions earlier issued on November 27 by the Division Bench.
Division Bench after hearing the submissions of Senior AAG Gagan Basotra who justified the continuation of the employees on the ground that such employees have not been challaned by the police in FIR NO 183/2013 of P/S Trikuta Nagar, however, Division Bench did not agree with the submissions of Senior AAG and observed that "We have apprised her (Additional Deputy Commissioner Jammu) that any person who is even remotely involved in the sexual harassment case of mentally challenged girls should not be kept on duty in the home and substitutes be supplied.
The direction is necessitated on account of the fact that some persons, who figured in the FIR or any other reports pointing out their culpability are still being kept as employee in the Home". Additional Deputy Commissioner Sushma Chauhan who is presently managing the affairs of the Home stated before the Division Bench that correctional steps shall be taken and the report shall be submitted within two weeks before the Division Bench.
Division Bench while parting with the case also issued notice to the President Rotary Inner Wheels, Channi Rama, Jammu who stands already arrayed as party respondent vide order dated September 24, 2013. Division Bench also directed the Registry to list this PIL on December 24, 2013 for further proceedings. JNF
